The rules of the road.

These Terms of Service ("Terms") are a binding agreement between you and My AI Lender (operated by [COMPANY LEGAL ENTITY NAME, INC.], "we," "us," or "our"). They govern your access to and use of myailender.com, the Mortgage at a Glance dashboard at app.myailender.com, and related services (collectively, the "Service").

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Heads up The Service generates content (scripts, articles, market summaries, daily content). You are responsible for everything you publish or send to clients and realtors. The Service is a tool to help you draft and deliver — it does not relieve you of NMLS, state, federal, fair-lending, or company compliance obligations. Review and approve all output before you use it.

1. Who Can Use the Service

You must be at least 18 years old.
You must be a licensed mortgage loan originator, mortgage broker, or otherwise authorized to originate mortgage loans in the states you reference in the Service.
You must provide accurate information at signup, including a valid NMLS ID and company affiliation.
You must comply with all applicable laws, including but not limited to RESPA, TILA, ECOA, the SAFE Act, state mortgage licensing rules, the CFPB's UDAAP guidance, and your company's compliance policies.

2. Your Account

You are responsible for safeguarding your account credentials and for everything that happens under your account. Notify us immediately at hello@myailender.com if you suspect unauthorized access.

One account per individual. Do not share your login. Each loan officer on a team needs their own account.

3. Subscription, Billing, and Cancellation

The Service is offered on a subscription basis. Pricing, billing frequency, and any free trial period are shown at checkout.
Billing is handled by Stripe. By subscribing, you authorize recurring charges to your payment method.
You can cancel at any time. Cancellation takes effect at the end of your current billing period; we do not refund partial periods unless required by law.
If your payment fails, we may pause or terminate access until payment is current.
We may change pricing or features with at least 30 days' notice to your account email. If you don't agree, you can cancel.

4. AI-Generated Content

4.1 What it is

The Service uses third-party AI (Anthropic's Claude API) to generate scripts, articles, content kits, prospect-finder prompts, market summaries, call summaries, and other written output based on the profile and data you provide.

4.2 Your responsibility

You are solely responsible for reviewing all AI-generated content before publishing, sending, or otherwise using it. The Service is a drafting tool, not a compliance certifier. Specifically:

Generated content is for educational and marketing purposes. It does not constitute a loan commitment, pre-approval, or offer to lend.
You must verify factual accuracy — including rates, payment amounts, program eligibility, and program limits — before using any output.
You must add any required disclosures (Equal Housing Lender, NMLS IDs, state-specific notices, advertising rules) before publishing.
You must comply with your state's mortgage advertising rules and your company's compliance policies.
You must not represent AI-generated content as personalized financial advice unless you have separately reviewed and confirmed it for the specific borrower.

4.3 No guarantee of accuracy

AI output can be wrong, outdated, or inappropriate. We do not warrant the accuracy, completeness, or fitness of any AI-generated content. Output may reflect biases or errors in the underlying models. Treat all output as a draft.

5. Third-Party Integrations

The Service can connect to third-party services including Arive LOS, Granola, Google (Gmail and Calendar), MBS Highway, and Stripe. When you connect a third-party service, you authorize us to access data on your behalf via that service's APIs. Each integration is governed by the third party's own terms and privacy policy.

We are not responsible for third-party services. If a third-party service changes its API, becomes unavailable, or restricts access, the corresponding feature may stop working until we adapt or until you take action.

6. Acceptable Use

You agree not to:

Use the Service to engage in unlawful, fraudulent, discriminatory, or deceptive practices.
Use the Service to send unsolicited communications in violation of TCPA, CAN-SPAM, or state anti-spam laws.
Misrepresent your identity, license status, or company affiliation.
Reverse engineer, decompile, or attempt to extract source code from the Service.
Use the Service in a way that interferes with or disrupts the Service or other users.
Resell, white-label, or sublicense the Service without our written permission.
Use the Service to scrape, redistribute, or compete with our AI-generated content corpus.
Use any integration credentials (Arive, Granola, Google) that you do not own or are not authorized to use.

7. Your Content and Our Use of It

You own the data you enter into the Service (your profile, your client and realtor lists, your KPI data, your generated content). You grant us a limited license to host, process, display, and back up that data only to the extent needed to operate the Service.

We do not use your data to train AI models. We do not share your data with other users or third parties except as described in our Privacy Policy.

8. Our Intellectual Property

The Service itself — software, design, branding, the My AI Lender name and logo — is owned by us and protected by intellectual property laws. These Terms do not transfer any ownership.

9. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding the accuracy or reliability of AI-generated output.

We do not provide legal, tax, accounting, or compliance advice. The Service does not replace your responsibility to comply with NMLS, state, federal, and company compliance requirements.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising from or related to the Service is limited to the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) $100. We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, regulatory fines, or business interruption, even if we were advised of the possibility.

11. Indemnification

You agree to indemnify and hold us harmless from any third-party claim, loss, or expense (including reasonable attorneys' fees) arising from (a) your use of the Service, (b) content you publish or send using the Service, (c) your violation of these Terms, or (d) your violation of any law or third-party right.

12. Termination

You can terminate your account at any time via Settings → Reset Dashboard or by emailing us. We can suspend or terminate your account if you breach these Terms, if your payment fails after notice, or if we are required to by law.

Sections that by their nature should survive termination — including IP, disclaimers, limitations of liability, indemnification, and governing law — survive.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of [STATE OF INCORPORATION], without regard to conflict of law principles. Any dispute will be resolved exclusively in the state or federal courts located in [COUNTY], [STATE], and you consent to personal jurisdiction there.

To the extent a dispute can be resolved by binding arbitration under your jurisdiction's consumer arbitration rules, the parties agree to arbitrate rather than litigate. Either party may seek injunctive relief in court for intellectual-property claims.

14. Changes to These Terms

We may update these Terms. Material changes will be announced via email to your account address at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
